News: Foundin Team Successfully Defends Patent Against Invalidity Challenge, Maintaining Patent Valid for US Client

Recently, through the relentless efforts of our team members, a patent represented by the Foundin team was maintained in full force by the China National Intellectual Property Office (CNIPA).

 

The case presented significant challenges due to its tight timeline and heavy workload. The US client only entrusted us with the case three days before the deadline, and we had to prepare all the documents on an extremely urgent basis for the oral hearing. The invalidation petitioner submitted 12 pieces of evidence, with the main arguments revolving around novelty and non-obviousness. Through the collaborative efforts of the Foundin patent attorneys, we identified deficiencies in 7 of the submitted pieces of evidence and provided technical rebuttals for the remaining 5. To maximize the chances of success at the oral hearing, we timely engaged with an oral communication with the examiner to highlight our opinion. Ultimately, we successfully helped the client to maintain the patent valid in its entirety during the oral hearing and received a positive decision from the CNIPA.
